Only products that comply with all legal requirements such as safety, health and environment may be marketed.  The manufacturer has the main responsibility to ensure this but importers and distributors also have obligations. Public authorities are responsible for surveillance of the market and for taking measures against economic operators who do not comply with legislation. EU guidelines for import control

To stop dangerous products already at the border is an important objective for customs and market surveillance authorities in the EU. The European Commission has therefore published guidelines to improve cooperation between authorities in their control of whether products imported from third countries comply with EU legislation. The guidelines are based on the provisions in EU Regulation 765/2008 setting out requirements for market surveillance relating to the marketing of products.
